These terms and conditions govern your use of Pink Lily Pad Ltd website and services. Please read these terms in full before you use our website. If you do not accept these terms and conditions, please do not use the website. Your acceptance of any quotation or continued use of our website confirms your acceptance of these terms.
1 Orders and Payment
1.1 Orders will only be deemed to have been made once full payment has been received in cleared funds.
1.2 We reserve the right to cancel orders if we are unable to fulfil the requirement for any reason. If we cancel an order we will issue a full refund.
1.3 Customers are responsible for all relevant taxes, customs and import costs. Pink Lily Pad Ltd is not VAT registered and does not collect tax on behalf of the Customer’s local tax authority.
2 Shipping
2.1 Your order will be processed and dispatched without undue delay, no later than 30 days after your order has been placed.
2.2 Orders are shipped by Royal Mail Standard 2nd class post or Royal Mail International Standard, shipping timescales can be found on royalmail.com.
2.3 Customers who require a tracking number must upgrade shipping to the relevant tracked service.
2.4 Claims for non-delivery can only be processed after 30 days (UK) or 90 days (international) following the dispatch of your order.
2.5 Non delivery claims cannot be accepted for items held by customs or subject to unpaid duties. It is the Customers responsibility to ensure they understand and accept their liability for relevant import costs.
2.6 Items returned to us by the delivery agent will be offered for re-despatch at the Customer’s cost. Cancellation of returned items will be subject to the terms listed in section 3.
3 Cancellations, returns and refunds
3.1 All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations. Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods. You must contact us in writing to cancel an order.
3.2 If an order has been cancelled, any goods must be returned to us at our contact address, in unused, saleable condition, at the customer's cost.
3.3 We will process credits for cancelled orders within 7 days of receipt of the returned item. If an item is not returned within 30 days, of the cancellation notification, it will be deemed that the order has been accepted in full.
3.4 Cancelled orders will be credited at the value of the purchased item, less any charges for shipping. Where an item is listed as "free shipping", credit will be at the value of the purchased item less £3.00.
3.5 You will not have any right to cancel an order for the supply of any goods that are made to the customer's specification or are clearly personalised.
3.6 In addition you will lose your right to cancel if goods have been used, worn or fitted in any way.
4 Materials
4.1 Please note that leather is a natural material, variations in its surface and texture are to be expected and do not constitute a fault.
4.2 Printed materials and plated metal products are manufactured in batches, please note that a variation in colour may occur between batches.
4.3 Products which are hand finished will display some variation across the batch.
4.4 Pink Lily Pad Ltd does not accept liability for the incorrect application or use of their products. Failure to follow accepted good practice, any installation or care instructions will void any right to cancellation, return or refund.
5 Exclusion of liability
5.1 Whilst we do take all reasonable steps to make sure that the information on our website is up to date and accurate at all times, we do not guarantee that all material is accurate and, or, up to date. All material contained on our website is provided without warranty of any kind. You use the material on our website at your own discretion. We do not accept liability for any loss or damage that you suffer as a result of using the website.
5.2 It is the customer's responsibility to ensure that the purchased product is of an appropriate specification and quality for the customer's intended use. We do not accept liability for any loss or damage that you suffer as a result of using any item purchased from us.
5.3 Our liability is limited to the purchase price of the item ordered, less any charges for shipping. Where an item is listed as "free shipping", our liability will be the purchase price less £3.00.
5.4 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.
6 Law and jurisdiction
6.1 These terms and conditions are governed by English Law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
